Analysis tools and third-party tools

Right to data portability
You have the right to receive the data we process by automated means – either on the basis of your consent or in performance of a contract – in a commonly used and machine-readable format. Access, blocking, erasure, restriction, objection

Notification obligation

No promotional emails
Third parties are expressly prohibited from using the contact details published within the framework of our obligation to provide a legal notice for the purpose of sending us unsolicited advertising and information materials. The operators of the pages expressly reserve the right to take legal action in the event of receiving unsolicited advertising, e.g. by means of spam emails.

3. Data collection on our website

Cookies
To some extent, our websites use so-called cookies. Cookies do not cause any damage to your computer, nor do they contain any viruses. Cookies are used to increase the user friendliness, effectiveness and security of our offer. Cookies are small text files that are stored on your computer by your browser. Most of the cookies we use are so-called "session cookies". They are deleted automatically once you have exited our website. Other cookies remain stored on your device until deleted by you. Server log files
The following information is automatically collected and stored in so-called server log files by the site provider and automatically transmitted to us by your browser:

These data will not be merged with other data sources. This data processing is based on Art. 6 Sec. 1 lit. f GDPR, which permits the processing for the safeguarding of the legitimate interests of the party responsible i.e. the controller. The data will be deleted after 6 months.

Analysis

Our website uses Matomo (formerly Piwik), open source software that allows us to statistically analyse visitor accesses. Matomo uses cookies, i.e. text files that are stored on your computer and allow analysing your use of the website. The information on your use of the website generated by the cookies is stored on our servers. IP addresses are anonymised before any storage takes place.

In this context, we respect the settings of the so-called DNT header (Do Not Track header). These are to be found in the privacy settings of all common browsers.

The cookies are stored on the basis of Art. 6 Sec. 1 lit f GDPR. The website operator has a legitimate interest in the anonymous analysis of the user behaviour to improve both their online offer and their marketing activities. The information on the use of this website generated by the cookie will not be disclosed to third parties. You can keep the cookies from being saved by changing the settings of your browser software. We point out that, in this case, you may not be able to use all the functions of this website. If you disagree with the storage and use of your data, you have the option to disable the storage and use.

Transmission of virtual shopping cart data and digital contents to a sales partner

Other than within the framework of the use of the virtual shopping cart, we do not transmit any personal data to third parties. The contents of the virtual shopping cart are transmitted to the sales partner selected by you within the scope of the contract initiation.
The data will not be transmitted outside this scope.

Your data will only be processed on servers operated by JEMAKO International GmbH, Germany. This can be done by JEMAKO Produktionsgesellschaft mbH, Germany, within the framework of order processing or order data processing. If it is necessary for procedures concerning Switzerland, your personal data will be passed on to JEMAKO Schweiz AG, Lavaterstrasse 40, 8002 Zurich, Switzerland, for further processing of your orders or enquiries. In addition, your personal data will not be processed outside the European Union, with the exception of the use of third-party software in accordance with the following provisions. All personal data processing activities of the companies of the JEMAKO Group mentioned here are carried out for the purposes mentioned here and in accordance with and in compliance with the provisions resulting from this data protection declaration. We also take all measures necessary to ensure the protection of your data. Your data will not be passed on to third parties for advertising purposes, for example.

The basis of this data processing is Art. 6 Sec. 1 lit. b GDPR, which permits the processing of data when necessary for the performance of a contract or precontractual measures.

Except in the cases set out in the "cookies", "server log files" and "analysis" sections, no data will remain stored once you have exited the website or when the virtual shopping cart is being forwarded to a sales partner.
As regards the handling of cookies, especially with regard to the deletion of the data collected by them, we refer to the "cookies" section of this Privacy Notice.

The sales partner you selected in connection with the virtual shopping cart is bound by the data protection regulations of their home country. In this regard, we refer to the privacy notice on the sales partner's website.

We refer to the data subject rights mentioned in section 2. Orders cannot be processed unless the personal data of the data subject are collected and processed.

Secure data transmission

JEMAKO ensures the secure transmission of your data by means of SSL and/or TLS (Secure Sockets Layer / Transport Layer Security) encryption. However, although no one can guarantee absolute protection, we secure our website and other systems by means of technical and organisational measures to protect your data against loss, destruction, access, modification or distribution by unauthorised persons.

Third-party software

This page includes third-party software solutions. If you use these, your data will also be processed by these third parties in accordance with the following instructions. The person responsible for this site usually has no influence on this. You use the third-party software at your own risk.

Google Maps

This page uses the map service Google Maps via an API. The provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
To use the functions of Google Maps, it is necessary to save your IP address. This information is usually transferred to a Google server in the USA and stored there. The person responsible for this website has no influence on this data transfer to Google Maps.

The use of Google Maps is in the interest of an attractive presentation of our online offers and to make it easy to find the places indicated by us on the website, especially for the sales adviser search. This represents a legitimate interest in terms of Art. 6 para. 1 lit. f GDPR.

YouTube

Our website uses plugins from Google’s YouTube site. The operator of this website is YouTube, LLC, 901 Cherry Ave, San Bruno, CA 94066, USA.

If you visit one of our pages equipped with a YouTube plugin and click on a video, a connection to the YouTube servers is established. The YouTube server is informed which of our pages you have visited. If you are logged into your YouTube account, you allow YouTube to associate your surfing behaviour directly with your personal YouTube profile. You can prevent this by logging out of your YouTube account.

The use of YouTube is in the interest of an attractive presentation of our online offers. This represents a legitimate interest in terms of Art. 6 para. 1 lit. f GDPR. Social media

Facebook

We maintain an online presence on Facebook, through which we communicate with active customers and other interested parties in order to inform them about our products.

We would like to point out here that user data can be processed outside the European Union. This can pose risks for you as a user, as the enforcement of your rights as a user could be made more difficult, for example. Facebook is certified under what is known as the Privacy Shield, an agreement between the EU and the USA regarding the processing of personal data (see also links below).

Users' data can be processed on Facebook for market research and advertising purposes. Thus, for example, user profiles can be created from the user behaviour and the resulting interests of the users. The user profiles make it possible, for example, to place advertisements inside and outside of Facebook that are likely to correspond to the interests of the users. Cookies in which the user's usage behaviour is stored are usually stored on the user's computer for this purpose. This can also be done by Facebook if you do not have your own profile on Facebook and/or are not logged in.
In addition, the user profiles may also store data that is stored independently of the user's devices used, especially if the user is a member of Facebook and logged in there.

The processing of users' personal data is carried out on the basis of our legitimate interest in effective communication with users in terms of Art. 6 para. 1 lit. f. GDPR. If Facebook users are asked to give their consent to the processing of data, for example by activating a checkbox or confirming a button, the legal basis of the processing is consent pursuant to Art. 6 para. 1 lit. a. GDPR.

In the event of requests for information and the assertion of user rights, we would like to point out that these can most effectively be asserted directly against Facebook, since only Facebook has access to the user data and can take appropriate measures and provide information.
